Facts About Class Action Settlement Involving Weyerhaeuser Hardboard Siding.

The Settlement

• Nationwide settlement of class action lawsuits related to the manufacture and sale of various styles of Weyerhaeuser-brand exterior hardboard siding.
• Weyerhaeuser will pay all timely and qualified claims (known as "claims-made" settlement) for damages associated with Weyerhaeuser-brand hardboard siding.
• No cap on the total monetary damages to be paid.
• Settlement includes homes or other structures with Weyerhaeuser hardboard siding installed from January 1, 1981 to December 31, 1999.
• The Court granted final approval of the Settlement on December 22, 2000.
  

The Claims Process

• If you requested a claim form prior to the Court's final approval of the Settlement, you will receive the claim form shortly.
• Valid and complete claim forms must be filed to be considered for compensation.
• Claim forms may be requested by calling 1-800-365-0697 toll-free, or visiting the website, www.weyerclaims.com.
• Claimants must prove they have Weyerhaeuser siding by various methods including visual identification ("AHA 10" or "AHA 20" stamped on reverse), copies of documents or receipts, sending a piece of siding in for determination along with a refundable $150 if found to be Weyerhaeuser.
• The claim filing deadlines are staggered (the more recently your siding was installed, the longer you will have to file your claim).
• Subject to certain exceptions for damage attributable to improper installation or building design, valid claims are those that relate to certain damages including swelling, buckling, sponginess, and other types of damage.
• An independent, objective inspection will take place after a claim form is submitted and verified.
• A court appointed claims administrator will determine the amount of payment due to a class member who has filed a claim based on the inspection report submitted.
  

The Notice Program

• Supplemental Notices have appeared in more than 100 newspapers in several "Key States" defined in the Court's notice program: California, Colorado, Oregon, Washington, Idaho, Texas, Arizona, Wisconsin, Nebraska, Minnesota, and Louisiana.
• The original Notice Program was a nationwide multi-media program which included: published notice in leading consumer magazines such as Parade, People, TV Guide, Newsweek and others, targeted radio advertisements and newspaper announcements in areas where Weyerhaeuser siding installations are most prevalent including 28 top markets in the 11 Key States, press releases, a web site (http://www.weyerclaims.com), and direct mail to prior warranty claimants and many home centers.
• The original Notice program advised class members of their rights and options prior to the Court's consideration of whether to grant final approval to the Settlement.
• Notices advise class members as to who qualifies to file a claim, when they can file a claim, how to go about filing a claim.
• The original Notice program also informed class members that they may opt-out or exclude themselves from the Settlement, or comment on the Settlement or claims process. These dates have now passed. If you did not take such action, you are bound by the terms of the Settlement.
• The Notice program announced the toll free number (1-800-365-0697) that people may call for more information.
• The original Notice program focused on homeowners and was designed to reach more than 90% of adult homeowners in the U.S.
  

Key Dates

• Settlement negotiations began in February of 2000.
• The Settlement agreement was reached on July 7, 2000.
• The Court preliminarily approved the Settlement on July 12, 2000.
• Notices will start to be disseminated on August 14, 2000.
• The deadline for all comments or for those class members who wish to opt-out (exclude themselves from the class) was November 13, 2000.
• The final Settlement hearing was held in San Francisco on December 21, 2000.
• On December 22, 2000, the Court approved the proposed Settlement.
• Claim filing deadlines are staggered in 3, 6, and 9 year increments:

1) Installations between January 1, 1981 and December 31, 1987: Claims due December 22, 2003.

2) Installations between January 1, 1988 and December 31, 1993: Claims due December 22, 2006.

3) Installations between January 1, 1994 and December 31, 1999: Claims due December 22, 2009.
